Terms of Use

These terms are an agreement between you and LINKOVA PTE. LTD., Singapore (“LINKOVA”, “we”, “us”), the publisher of the Hesper app (“Hesper”). By using Hesper you agree to them and to our Privacy Policy. If you don't agree, please don't use Hesper.

1. Who can use Hesper

You must be at least 18 years old and able to enter into this agreement. Hesper is for personal, non-commercial use.

2. What Hesper is, and what it isn't

• Hesper offers astrology and tarot readings and conversations written by artificial intelligence, for entertainment and self-reflection. Every AI text in the app is labelled as AI-generated.
• Astrology and tarot are not sciences. Readings describe possibilities and moods to think about; they don't predict the future or determine your character, your relationships or your choices.
• Hesper is not medical, psychological, legal, financial or other professional advice, and it is not a substitute for a qualified professional. Don't rely on it for important decisions.
• You are always talking to an AI, never to a person. AI can be wrong, incomplete or inappropriate. If a reply seems harmful, please report it in the app (long-press the reply, then Report).
• Hesper is not an emergency or crisis service. If you or someone else is in danger, contact your local emergency number or a crisis line right away. See our Safety page.

3. Your account

Hesper creates an account linked to your device; no login is needed. You're responsible for activity on your device and for keeping it secure. You can delete your account at any time in Me → Settings → Delete account.

4. Your content

You keep ownership of what you enter in Hesper, such as your profile, the people you add, your messages and notes. You give us a worldwide, non-exclusive, royalty-free licence to store, process and transmit it as needed to run Hesper for you, including, if you allow it, sending it to our AI providers as described in the Privacy Policy. This licence ends when you delete the content or your account, except for copies we must keep by law or that remain in backups for a limited time.

Only add information about other people if you're comfortable sharing it and are allowed to.

5. AI-generated content

You may use the readings and replies Hesper writes for you for your own personal purposes. Because they are generated automatically, similar text may be produced for other people, and we don't claim that any output is unique, accurate or suitable for a particular purpose.

6. Acceptable use

Don't use Hesper to:

• break the law, or harm, harass, threaten or impersonate anyone;
• try to make the AI produce illegal, sexual, violent, hateful or otherwise harmful content;
• enter information about others that you aren't allowed to share;
• access Hesper by automated means, overload or disrupt it, get around its limits or security, or copy, scrape, reverse engineer or resell it, except where the law allows this despite this restriction.

We may limit, suspend or close access for anyone who breaks these terms or puts others at risk.

7. Free service and changes

Hesper is currently free to use, with daily limits on chat messages. We may add paid features in the future; they will be offered through the App Store or Google Play under the terms shown at purchase, and nothing will be charged without your confirmation. We may change, add or remove features, or stop offering Hesper, and we'll try to give reasonable notice of important changes.

8. Our rights

Hesper, including its software, design, texts, illustrations and the Hesper name, belongs to LINKOVA or its licensors. We grant you a personal, non-transferable, revocable licence to use the app on devices you own or control, under these terms and the rules of the store you downloaded it from.

9. Disclaimers

Hesper is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and we don't promise that Hesper will be uninterrupted or error-free.

10. Limitation of liability

To the extent the law allows, LINKOVA will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Hesper or of any AI content, and our total liability for any claim relating to Hesper is limited to the greater of the amount you paid us in the 12 months before the claim and USD 50. Some places don't allow these limits, so they may not all apply to you. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

11. App stores

If you downloaded Hesper from Apple's App Store, Apple's Licensed Application End User License Agreement also applies, and these terms are between you and LINKOVA only, not Apple. Apple has no obligation to provide maintenance or support for Hesper and is not responsible for any claims relating to it, including product liability, legal or regulatory compliance and intellectual property claims; LINKOVA is responsible for these as far as these terms and the law provide. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you downloaded Hesper from Google Play, Google Play's terms also apply.

12. Ending this agreement

You can stop using Hesper and delete your account at any time. Sections 4 (for content we may still hold), 5, 8, 9, 10 and 13 continue to apply after the agreement ends.

13. Law and disputes

These terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction, unless the law of the country where you live gives you the right to bring a claim there or requires its law to apply.

14. Changes to these terms

We may update these terms. We'll change the date above and tell you in the app before an important change takes effect. If you keep using Hesper after that, the new terms apply.
